Required change in constitutional position of governor in view of Partisan politics of Bhardwaj

Mr. Bhardwaj was Law minister in central government of Congress before being appointed Governor of Karnataka. It was expected of him that being well versed in law he well fallow legal and constitutional procedure in dealing with Yeddyurappa government of Karnataka of the opposition BJP. But Bhardwaj started playing partisan politics, bringing bad name to himself and causing worry to Monmohan Singh government of UPA II by carrying out persistently campaign to oust Karnataka government of Yeddyurappa. The entire BJP has marched to Rashtrapati Bhavan to dismiss Bhardwaj for his unconstitutional and partisan efforts over a long period. Bhardwaj after failure to oust Yeddyurappa government of Karnataka,continued his campaign against Karnataka government which had 120 out of 224 members in Karnataka Assembly and BJP government of Karnataka could easily win the vote of confidence if and when the issue of voting was taken up.

There have been many governors even for decades like Shri SS Barnala who have not interfered at all in the working of state governments when he had been governor of one state or another. No government ever raised a finger that Barnala was partisan. In SR Bommai case the Supreme Court had passed the verdict that the state government can’t be dismissed without a floor test in the state assembly. Was Bhardwaj who was law minister unaware of the decision of Supreme Court? Then why he had been insisting for the ouster of Yeddyurappa government.

UPA II government should have silenced Bhardwaj long back to set a lasting example so that in future no governor works in partisan manner but sticks to only constitutional provisions. Secondly it will be better that governor are non political and non partisan. Accordingly retired judge of High court and Supreme court may be appointed as governors of states. If need be there may be
constitutional amendment to this effect.

On 18th May 2011, Bhardwaj all of a sudden changed his attitude and became friend of Yeddyurappa whom he had considered his enemy and had been trying his best to oust. All this has happened because the government felt embarrassed because of BJP’S parading all the MLA’S before the President of India so Bhardwaj was advised to be friendly with Karnataka C.M even to save his own position as governor. This could have happened atleast 10 days earlier but it is better late than never so that the UPA II can maintain some rise in its popularity, despite Bhardwaj partisan behavior as Governor of Karnataka for many years.

With Bhardwaj becoming friendly with Karnataka CM, the crisis is over and UPA II can continue to rise . Other important feature is that with the arrest of A Raja and many corrupt minister and officials the corruption in government has declined very much thus there is possibility of India becoming corruption free democracy. All this will lead to rise in popularity of UPA II and virtually no fall at all in its prestige. Thus there will be substantial rise instead of some rise to the benefit of UPA II and enhancement of its popularity.

From steep fall to some rise of UPA II

From 2009 to March 2011, UPA II had been facing fall in its popularity because of large scale corruption exemplified by 2G’s A Raja, Balwa and many others some of whom are in jail today. Aee this tarnished the image of UPA II. Congress ally Karunanidhi’s DMK by prolonged corruption by A Raja and others when Karunanidhi defended for more than six months, not allowing UPA II to dismiss A Raja for corruption in spectrum licenses .When ultimately Karunanidhi agreed to allow dismissal of A Raja Union Minister, it was rather too late. Still For months because of investigation and finally when charges of corruption were proved he was put behind bars along with his associates Balwa now even Kanimozhi, daughter of Karunanidhi who had been supporting A Raja and was part of A Raja’s corrupt practices may be sent to jail after a week or so.
UPA II not being assertive during these two years, fearing karunanidhi’s DMK withdrawing support to UPA II and even leading to its fall. Both Manmohan Singh PM of UPA II for 6 years and Sonia Gandhi UPA II chairperson were silent spectators to decline of congress and UPA II during two years. They did not even utter a word against DMK of Karunanidhi. Thus UPA II continued to suffer humiliation for almost two years and continued to fall in the eyes of all public and all political parties. On the other hand karunanidhi’s DMK had the worst humiliation because of its complete fall in the early 2014 election giving way to AIADMK’S Jayalalitha to have landslide victory and become CM of Tamil Nadu, Luckily, fall of karunanidhi and his DMK led to the rise of UPA II though congress itself did not win or won more than a few seats both in West Bengal and Tamil Nadu. But some rise of congress UPA II continues because of Jaya Lalitha’s alliance with congress and Mamta’s association with congress for landslide victory in West Bengal.
To maintain its rise, UPA II has to modify its policies, even remove from cabinet many ministers who are only spokes person but otherwise ineffective in their thoughts and actions.
If UPA II wants to continue to rise even at lower rate it has to mend its ways. First of all it should take steps to reduce corruption and ultimately become as far as possible, corruption free democracy. It should control inflation and maintain increase in production of industries and even agriculture and fisheries. How can all this be done? Support and alliance with Mamta Banerjee, West Bengal CM and Jayalalitha CM of Tamil Nadu has already compensated for the ouster of Karunanidhi’s DMK in centre. To maintain the rise in states of UPA II in the Lok Sabha election of 2014, in place of Left in west Bengal and Kerela and in place of DMK of Karunanidhi, AIADMK of Jayalalitha, there will be competition between two major national parties, Congress and BJP. By increasing petrol price by Rs 5 per litre, Congress has given an opportunity to BJP to demonstrate at national level and win the support of people all over the country. Congress and UPA II have to be more careful so that there is not much rise in inflation.

Congress should fallow new pattern of inclusive growth. Sustainability of growth process is one factor, the other is reform of public sector, efficient public and private partnership. The other important aspect is understanding and implementing politics of competitive pluralism and secularism and spirit of cooperative federalism. Pakistan our hostile neighbour has developed nuclear technology so much that it has replaced France and has become 4th nuclear power in world after USA, Russia and China. India should pay more attention to its national security and foreign policy. India needs American support to get culprits of 26/11, like Rana and others and also against Pakistan. Next two years are of vital importance for India, as explained, to keep some rise by maintaining excellent growth process and more production, more export and getting much more foreign exchange. India must be careful as it cannot afford political destabilisation during next two years and should be determined to rise.

Election Results 2014- Fall of Karunanidhi and rise of Jaya Lalitha. Defeat of Communist in West Bengal after 35 years and rise of Mamta

It is for the first time that communist who have ruled West Bengal for 35 years, largest in Indian political history for any political party have suffered humiliating defeat from Mamta Banerjee, who has been working and aspiring to be chief minister of her home state. Defeat of Communist and victory of Mamta both are historic. It is an old saying that power corrupts and obsolute power corrupts absolutely. At least during last ten years of their rule Communist did not achieve anything for the benefit of Bengali poor or even for Bengal itself. With Tata’s Nano being shunting out of West Bengal and communist suffered a lot because of not only Tata’s but other industrialist and big businessmen avoiding or refusing to set up any industry in West Bengal. Mamta’s TMC has finally won 217 seats and the left only 68.

Because of arrogance of DMK and its leader Karunanidhi and corrupt practices, not only by Raja but actually all the ministers of DMK at centre and Tamil Nadu it proved to be the most corrupt party and government particularly during 2009 to 2011 for which it has paid a heavy price by getting virtually wiped out from the home state Tamil Nadu. Jaya Lalitha, years or so back never expected that she will over throw the well entranched political party DMK and she and her AIDMK will have a chance to form government in Tamil Nadu after gap of more than decades and she will be chief minister of Tamil Nadu and her AIDMK will rule. Finally as election results are out AIDMK of Jaya Lalitha he won 192 seats against only 40 by DMK.

Thus both DMK’s defeat and Jaya Lalita and her AIDMK’S victory are historic. It is to be seen whether she and her party and ministers will learn lesson from
Karunanidhi’s DMK fall and rule honestly and achieve good result during first term so that they continue to rule atleast for two terms and for Tamil Nadu and also attain some remarkable results by uplifting conditions of poor and those below poverty line in Tamil Nadu. Not only Tamil but whole country will be keeping in watch and noting progress in this direction.

Victory by two women politician and their being chief minister of their states is a tribute to democracy in India as well as equality of women in India whose effort and success is appreciated. In contrast in no other democracy including USA there are three women CM’s or head of states ruling their big states UP, West Bengal and Tamil Nadu which constitute more than 30% of India’s population.

On the other hand ruling congress party of Sonia Gandhi as UPA head and Manmohan Singh as a PM have suffered humiliating defeat in West Bengal and Tamil Nadu because of their highest level of corruption during 2009 to 2011 which ruined DMK and congress and its so called corrupt allies. Though Congress has won comfortably in Assam but their loss else where in bigger state Tamil Nadu and west Bengal and elsewhere where many UPA minister and officials have brought humiliation to ruling congress which inherited legacy from Gandhi, Nehru and others since 1947.

Rise And fall of Sharad Pawar

At the age of 37 Sharad Pawar entered politics and became MLA for the first time. It is not known what amount of money and property he had at that time. But it appears that he had moderate amount of assets, not in hundreds of crores of rupees. How in 40 years of politics he amassed lakhs of crores of property, lakhs of crores of gold and hundreds of lakh of crores Shares and prime property? His lust for money property and power made him almost richest of politicians in India. In recent times this very lust for power and money has become a curse for Sharad Pawar just as it had become for 2G ‘ A Raja . That is the life story of Sharad Pawar’s rise and fall which is explained in details. It must be said at outset that all those who have lust for money invariably adapt foul means because with fair means one can only be moderately rich by his honest efforts over decades or even in one’s life time.

Sharad Pawar became the richest politician but in fact had become one of the richest within 20 years and thereafter broke all limits today after being in politics for 40 years. To his credit during the process of attaining unprecedented heights in politics and property he triggered agricultural revolution and had he concentrated on his unique achievement he could be Prime Minister of India. But that was not to be. He fizelled his energies.

Sharad Pawar during his political career extending to 40 years became CM of Maharashtra a number of times. Similarly by joining Congress he became Minister in Central Government for many years. He even joined Manmohan Singh government when congress returned to power in 2004 and continues to be so till today despite his indulging in unprecedented corruption known to not only congress but all political parties, politicians and ordinary workers and citizens. It was Anna Hazare who had taken first step to tarnish his image and had named him corruption personified. He for the first time in 40 years of his political career realised that his days as politicians are numbered and that soon he will be charged for massive misappropriation of public money running into lakhs of crores of rupees. Thus, though Pawar got so much worried and conscious of his follies over 40 years, he declined award for social justice which he was about to receive on April 17, 2011, the function for award was postponed hurriedly as Pawar now had become conscious that dark cloud of corruption were encircling him all over and that there seemed no escape for him, for his wife Pratibha and his causion Ajit Pawar who had looted the exchequers of lakhs of crores of rupees unaccounted and were now becoming evident as never before.

Now about Pawar family assets to this day, While Sharad Pawar is reputed to have collected by foul means more than 800 gram of gold while Pratibha is reputed to have more than 250 gram gold and besides many kg of silver. Thus Sharad Pawar family possess 15 acres of non-agricultural farmland. Family usurped commercial property of about 12000 sq ft in Pune and Malegaon. The most startling assets are deposits. In Sansad Vihar society New delhi deposits are worth Rs 10 lakh, While in Lap Finance and consultancy deposits to Rs 66 lakhs. In addition more than 2 lakh shares are owned by Pawar family of Namrata Film Enterprise Ltd. Just to name a few more companies in which Pawar family had shares, Viz Panchsheel Hotels more than 3 lakh shares, Baramati Agro and Katha Developers and Miners. Even in Reliance, Birla, Tata and Wipro companies the Pawer family had shares.

In recent times one does not hear about Sharad Pawar’s achievements particularly his concept of agricultural revolution but one only hears about kind of fake that Pawar has. Almost everyday the so called mighty Marathi is involved in unprecedented and innumerable controversies. How AG Mercantile, a company partly owned by Pawar got prime land on 99 years lease of 93,000 sq feet. Also how in 2008 the company got additional 97,000 sq ft land for building road and a bridge in Mumbai-Pune highway ? Acquisition of prime land has become Pawar’s political agony today. Inspite of the fact the controversies swirled around Pawar, which was tarnishing further the image of UPA II, Pawar could not be ousted or toppled as that was likely to lead to fall of government, both in Maharashtra and at centre though government is putting pressure on Pawar by occasionally leaking information against him, his corruption and scams. Pawar’s known contact with Balwa, associate of A Raja, Nira Radia and his daughter’s husband Sadanand Sule associated with automobile giant Mahindra and Mahindra has become talk of the day. Pawar is now suffering humiliation and does not appear in public view because of his passion for becoming the richest politician of India, which has become his life’s biggest curse, and has led to his fall.

Impact of Osama Bin Laden’s killing by America.

Obama, President of USA, in particular, had claimed credit for getting killed Osama bin Laden, master-mind of 9/11 attack on Twin Tower in America that destroyed both the towers, killing more than 300 innocent Americans and some foreigners. Since 9/11 USA has been trying its level best to rope in Osama but as Pakistan Army and ISI were protecting him in his hideouts all the time, so there was no success. It is only on 1/5/11 the US intelligence without a hint to anyone even in America organised secret operation to kill Osama in his new hideout of more than a billion dollars constructed by Pakistan close to Pakistan Army regiments. It was a massive building enclosed by high boundary wall guarded by Pakistan Army where Osama bin Laden along with his wife resided with only contact with ISI.

Elimination of Osama bin Laden is no doubt a great achievement for Americans as well as President Obama. But it has far reaching implication. Osama had thousand of followers of El-Quaida and Taliban in Pakistan and even Afghanistan. How can they be happy on the killing of their undisputed leader for decades. These followers are well entrenched in Pakistan, particularly in difficult terrain of Baluchistan bordering Afghanistan and part of NWFP and now even in Punjab and Sindh, from Rawalpindi to Lahore as well Karachi and inaccessible part of Sindh. America is aware of that the LeT was trying to expand and become leader of global Jehad. Homeland Security Council has expressed grave concern in expressing danger world wide particularly terror attacks against India and participating in global Jehad as Lashker is trying to be new El Queda: Already there has been new bomb threat though considered hoax in Delhi which created panic. US envoy to India has already voiced concern for India because of threat by LeT and other terrorist groups in Pakistan after Osama’s killing by US. US Envoy specially referred to 26/11 attack in Mumbai. They (terrorist) killed hundreds of Indians in the 26/11 attack they killed six Americans, too.

In US Congress there was demand that “not a cent” should be given to Pakistan in aid as Pakistan has been using billions of dollars American money to finance terrorist organization like El- Qaeda. On the other hand Pakistan since Osama’s elimination has been openly threatening India.

India today in its cover story has called Pakistan Terroristan. Though by the killing of Osama, America has accomplished the mission after 15 years of 9/11 attack on Twin Tower in USA. But now Americans and even President Obama are no longer as jubilant as they were on May 1 and 2. They are worried about possible repercussions by global terrorism of Pakistani Jehadis who already had meeting in Quetta Jamiat Ulema-e-Islam protesting vigorously against Osama bin Laden having been killed by Americans. Many Pakistanis protest against American’s violation of Pakistan’s sovereignty. Pakistani Army generals have been put to shame as American operation against Osama was close to Kakal Military Academy in Abbottabad. Pakistan Army onlookers. On successful completion of mission by President Obama, he rang up Pakistan President Asif Ali Zardari to convey what American had done to kill Osama bin Laden. But America CIA director added that USA had not given notice to Pakistan about the operation ‘because it feared that it may be leaked to EL Qaeda supremo’. Was this the way to treat Pakistan an ally of USA fighting against terror in Afghanistan and Pakistan getting hundreds killed by suicide bombing over last 11 years? Pakistan is in real dilemma whether it should continue to be ally of USA against the violent threats of El-Queda to Pakistan. America, too, is in dilemma as though it also cannot do without alliance with Pakistan. However latest news is that El-Qaeda and Laskar have openly threatened that it will take revenge from USA for killing Osama bin Laden even by launching an attack on America this threat is now cause of real worry to President Obama and American intelligence and people.
